Short answer

In most claims, you pick the shop. Your insurer can recommend the shops in its network, but a recommendation is not a requirement. The exception depends on your policy: some policies let the insurer elect to repair the car itself, and then it can require a particular shop. When that happens, section 626.9743(3) of the Florida Statutes puts the obligation on the insurer to return the car to its condition before the loss, at no extra cost to you beyond what the policy states. So read the repair section of your policy and ask before you accept a shop you did not choose.

  • Ask

Is this a suggestion or a requirement?

Ask the adjuster plainly. If it is a suggestion, you can decline and name your own shop.

  • Ask

    Are you electing to repair?

If the answer is yes, ask which part of the policy they are relying on, and get it in writing.

  • Ask

Who answers if the repair is wrong?

When the insurer picks the shop, ask who you go to if something does not look or work right afterwards.

  • Ask

Can I get a copy of the estimate?

Whoever does the work, you should see what is being repaired, what is being replaced, and with which parts.

FAQs

Can my insurance company make me use their shop in Florida?

Usually not. In most claims you choose where the car is repaired, and a network recommendation is only a recommendation. The exception depends on your policy: if the insurer elects to repair the car itself, it can require a particular shop, and section 626.9743(3) of the Florida Statutes then obliges it to return the car to its condition before the loss at no extra cost beyond what the policy states.

What does it mean when an insurer elects to repair?

Some policies let the insurer take charge of the repair instead of paying for it. When it uses that option, it takes responsibility for the result and can choose the shop. Your policy says whether that option exists, usually in the physical damage or collision section.

What should I ask if my insurer suggests a shop?

Ask whether it is a suggestion or a requirement, whether they are electing to repair and under which part of the policy, who answers if the repair is not right, and whether you can get a copy of the estimate. If it is a suggestion, you can name your own shop instead.
